Planning Commissioners Discuss Protest Petitions and Legal Challenges to Data Center Rules

Members of the Dickinson County Planning Commission on Oct. 15 discussed how the public could challenge future data center decisions, including protest petitions and recent lawsuits in other Kansas counties.

A commissioner referenced litigation involving Butler County, where he said a data center was approved through the planning commission and the public then petitioned to overturn the decision. Staff explained that courts typically overturn planning or county commission decisions only when there is a procedural problem, such as failing to provide proper public notice or publication, or failing to consider required factors for conditional uses.

Commissioners also discussed differences between cities and counties in how residents can petition. Staff and commissioners noted that in cities, residents can obtain signatures from 20% of registered voters on a petition, and that some jurisdictions, such as Emporia, are treated differently under state statute because of their more urban character. Staff confirmed that in the county, land use resolutions and amendments remain subject to a 20% protest petition.

One commissioner said he would like to hear from legal counsel on whether residents in unincorporated county areas could vote on data center regulations, recalling earlier public testimony that "the people should be allowed to vote."
